SUMMARY:

This position is responsible for leading Tyson’s regulatory compliance program in the areas of data privacy and cyber security incident response, including risk assessment and mitigation. The position will also review technology-related contracts to ensure that proposed terms and conditions satisfy regulatory requirements and adhere to Tyson information technology and data privacy and security standards. The position will be based out of the United States. The individual filling this role will be a part of the Tyson Foods Law Department, reporting into Tyson’s Chief Compliance Officer.

The Senior Compliance Counsel for Data Privacy, Cyber Security & Technology will serve as a trusted legal advisor to the enterprise and to senior leaders of the Company, its subsidiaries and its enabling functions such as Information Technology, Human Resources, Finance & Accounting and Records Retention.

PRIMARY RESPONSIBILITIES:


Serve as a key member of the legal team with responsibility for providing leadership and management of Tyson’s global data privacy program and cyber security incident response.

Collaborate with the Chief Compliance Officer and internal Tyson stakeholders to develop and implement strategies, global standards, policies and processes for Tyson’s global data privacy compliance program, including compliance with the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA) compliance.

Serve as the main contact for external data privacy attorneys and serve as the Data Privacy Officer (DPO) for the Company.

Collaborate cross-functionally with colleagues to drive implementation of the program and proactively build relationships throughout Tyson to gain key partner and stakeholder support and commitment.

Communicate regularly with key stakeholders on strategy, developments, and trends and implement systemic solutions that address strategy and trends.

Collaborate with team members to advise on data privacy matters related to products and offerings and develop, rollout, and conduct generic and role specific privacy trainings, build data privacy capabilities and awareness across Tyson, including by supporting training, problem-solving and knowledge development.

Draft, negotiate, and advise on impact assessments, data process agreements and data privacy terms in commercial agreements and advise on other privacy concerns, including in connection with onboarding vendors and other third parties.

Advise the organization on data privacy matters, including related to partnerships and acquisitions.

Remain current and advise on regulatory and industry developments, including monitoring trends in privacy and security laws, regulations, and public policy.

Proactively manage and mitigate Tyson’s data privacy risk.

Utilize his/her understanding of broader legal, regulatory, and market risks and trends to influence development of legal strategy and proactively re-evaluate and re-prioritize tasks, projects and strategic objectives based on such information.

In conjunction with the internal investigations team, security team and others, assisting in investigations regarding reported or observed data privacy incidents to ensure expeditious resolution.


QUALIFICATIONS:

Education/ Experience:


5 years as a data privacy attorney in private practice advising corporations and/or as an in-house attorney in a corporate legal department with direct experience advising on US and European privacy laws, regulations and industry guidelines.

Strong academic credentials from an accredited law school

Licensed to practice law and in good standing in state of residence

Applicants must have extensive knowledge of global privacy and data security laws, including the EU General Data Protection Regulation (GDPR) and the California Consumer Privacy Act (CCPA), as well as state data breach notification laws and data security standards.

Candidates must have extensive familiarity with legal concepts, practices and procedures applicable to data security and cyber incident response.

CIPP/E and CIPP/US certifications are a plus.

Strong critical and commercial thinking skills with a commitment to open communication and exchange of views.

Strong experience in dealing with compliance and/or internal investigations in or on behalf of a multi-national company.

Experience in dealing with diverse cultures preferred.

Strong commitment to and reputation for ethics and integrity; ability to exercise independent judgment, objective thinking, and decision-making.
